NOTICE OF PUBLIC HEARING BEFORE LAWRENCE COUNTY PLANNING AND ZONING COMMISSION

ORDINANCE AMENDMENT # 19-01

NOTICE IS HEREBY GIVEN that a public hearing will be conducted by the Lawrence County PLANNING AND ZONING Commission to consider adoption of the FOLLOWING SECTION(S) or REGULATION(S) AS ESTABLISHED BY THE LAWRENCE COUNTY ZONING ORDINANCE, ORDINANCE NUMBER ONE, BE AMENDED, IN PART, AS FOLLOWS:

Summary of Changes in the 2019 Lawrence County Subdivision Ordinance

Chapter 3 - Correction Plats and Re-plats (II-3.001)

  • Deletion of replats

Chapter 4 - Subdivision Exemptions and Exempt Plats (I-4.002)

  • Clarification on types of subdivision exemptions

Chapter 5 - Plat Application Procedure; Approval process; Specification of Documents (I-5.001; I-5.002 ; I-5.003; I-5.004; I-5.005)

  • Clarification on process; requirements; fees and plat standards

  • Deletion of some text

Chapter 6 - Requirements for Improvements, Reservations and Designs (I-6.001; I-6.006; I-6.007; I-6.008; I-6.009; I-6.013; I-6.015)

  • Clarification on licensing requirements

  • Text amendments throughout

  • Clarification on fire plan process & requirements

Summary of Changes in the 2019 Lawrence County Zoning Ordinance

Chapter 3 - Definitions (II-3.001)

  • Consistency in terminology

  • Deletion of Unused Definitions

  • Addition of New Definitions

Chapter 6 - District Regulations (II-6.001; II-6.002; II-6.003; II-6.004; II-6.005; II-6.006; II-6.007; II-6.008; II-6.009; II-6.010; II-6.013)

  • Deletion of certain allowed and conditional uses in all zoning districts

  • Addition/clarification of certain allowed and conditional uses in all zoning districts

  • Addition/deletion/clarification of certain requirements for density and setbacks in all zoning districts

  • Update Floodplain District regulations to be consistent with state and federal requirements

Chapter 10 - Additional Use Regulations - II-10.012 Guest Houses

  • Rename Covered Deck to Enclosed Deck

  • Deletion of 45’ setback between primary dwelling and guest house

Chapter 13- Building Permits (II - 13.002 and II - 13.004)

  • Clarification on number of plans; scale of plans and International Building Codes

A complete copy of this Amendment shall be available at the Office of Planning and Zoning and the Lawrence County Auditor’s Office.

NOTICE IS FURTHER GIVEN that said amendment will be heard by the Lawrence County Planning & Zoning Commission in the Commissioner’s Meeting Room Lawrence County Courthouse, 90 Sherman Street, Deadwood, South Dakota on the 7th day  of  March, 2019 at 1:30 p.m., to hear and consider such amendment.  

Any person interested in the approval or rejection of such ordinance may appear and be heard or file with the Lawrence County Planning and Zoning Administrator a written statement of approval or disapproval.
